View Full Version : [RESOLVED] Submission rules - thumbnails included?

I don't mean to get anyone in trouble, but I was wondering...do the submission rules in regards to uploading material that isn't your own also cover the content displayed in thumbnails? I imagine they do, but I just wanted to ask.

The reason I ask is because the user DasherWhitetail has uploaded some stories, and the thumbnails uploaded with them are sample wallpapers taken directly from Windows XP that said user obviously did not create themself. I don't wish to see FA close down due to cease & desist notices from Microsoft and whatnot, so I thought I'd just let you know, and ask for clarification on this subject.

hmm.. an interesting question for sure...
on the one hand, you are right, but on the other... uhmm... that leaves not much choice for a thubmnail you can use - because anything in the net is done by somebody - and that 'somebody' might be offended (don't know why thou - this is just another form of compliment to me).

i have very litle info on how such cases of cease & desist are handled where you are - but wouldn't closing down an entire community for just a simple thubmnail be a little too much? i mean, most of the time it is suffice to just give a note requesting for it to be taken down.

in other words i think this is not significant enough to cause any trouble. heh, TOS and Submission agreement is pain as i can see ^^

Well, all artwork is copyright. Uploading any material that didn’t belong to the user (including picture bio) wouldn’t be allowed on Elfwood, and they follow copyright very strictly (and rightly so imho)

But the user could always ask permission from an artist/photographer to use their work. That’s their best way of keeping themselves in the clear. The other option would be to take a photograph themselves.

Sorry for bumping this old thread, but I think this question still remains somewhat unanswered. That, and I've come across another situation that fits under this questionable issue, perhaps moreso than the earlier one involving the Windows wallpapers.

The user "kingthewrestler" has uploaded a story, and the thumbnail being used for it is a drawing made by Karabiner (At least I think it's Karabiner's if I'm remembering correctly), a picture that "kingthewrestler" obviously didn't make himself, nor is any evidence shown that he was given permission to use Karabiner's art in this manner.

I'd say there should be some kind of moderation of thumbnail images. From what I recall Karabiner doesn't like his stuff being used like that. I believe the image is off one of his CDs, which probably also puts that thumbnail in the wrong. It would probably be prudent to take care of this because the image isn't technically publicly available online.

I'm just going to bump this back up again since there hasn't been an answer to it yet. I wouldn't be as concerned, but it would be better to clarify this kind of thing before users start randomly picking pictures to use as thumbnails, even without permission from the artist.

I'll look into it tonight. We may have some upcoming content rules changes.
