It can be both. We'll have to take in a number of factors. Is the artists style chibi-like, is the character something that would traditionally be smaller, does it appear to be sexually immature, or using language/actions that would signify it as a child. Things we'll take into effect.

What we won't allow is witchhunting.

Hypothetically speaking, what if a reputable payment processor could be found that didn't care about cub content? Just playing the devil's advocate.

Nope. Usually it's in their ToS. If your account is cancelled due to violations or because they feel it, any funds can be confiscated. That's the big beef people have with Paypal, is that they'll seize your funds at the slightest provocation, with no appeal.

Here's a question to Dragoneer:
You say that Alertpay have cancelled the account with no appeal, and Paypal won't let the site anywhere near it due to pornography, what options are left. Or are the AUP changes part of building a case to put to Alertpay to reopen or allow an account? If Alertpay and Paypal are out, there aren't many other secure options, so it seems to me this may be a touch late to actually make any difference. Horse/stable/bolted analogy.

I knew sooner or later that something like this would have happened. If not, the mainstream media would have picked it up and FA and the entire fandom would be permanently dragged into the gutter.

Cub porn should have never been allowed on the site in the first place. Not only out of a sense of moral decency, but also out of consideration for the site's reputation and the reputation of the fandom as a whole.

I remember somebody brought up the Shippo character from Inuyasha and how he looks/acts 7 but is actually a fox demon about 50 years old... that's a good example of why personality and connotation are more important than age with fictional characters. Good stuff.

That'd have to go, unfortunately... unless somebody wanted to "age up" the character visually. Legal groups and bean counters don't see that as being "legit". They'll just look at the visuals and go off that.

And... Shippo acts like a 7 year old demon fix, not a 50 year old, so... that'd totally not go in his favor, either.

I understand sexual ones. But what if, say a young character finds his way in to a strip club and watches but doesn't partake. Is that counted as Cub porn? I'm asking because this needs to be fleshed out deeper then that or people will root out loop holes.

Well, it was bad enough when Fa "admins" deleted my photographs of a light bulb zoomed in really far and network cable for "emphasizing a brand name", (which were just explanations of different ways of connecting speakers, and a photography tutorial). I'm not big on cub art myself. But the part that bothers me about this whole thing is that corporations are being allowed to control freedom of speech and freedom of expression by simply cutting off those who don't want to follow their ideas of what is acceptable, and what is not. We should have laws that prohibit corporations from denying services to someone based on these kinds of things, because it effectively prevents people from exercising Constitutionally guaranteed rights. How long before they tighten the screws even further and say that all furry art that depicts nudity fits in their definition of obscene, and start canceling accounts based on that?
