What it means is, if you are arrested they will either put you as male or female, depending on what functional parts you have. The law will always see you as either male or female.

I didn't say your eyes, I said "eyes of the law" besiudes if that person still has a fully functional penis or vagina then that makes them a male or female, you can't be both and can't be the other without the original one gone.
