Where do you people keep getting the idea that this is used for cheating, btw? Do you know anything at all about what the Xbox 360 drive-mods allow? Here's a cheat-sheet...

You can boot 1:1 backups (that means, identical to retail, NO DEVIATION), from YOUR region, on your console.

Modifying the disk to cheat breaks the stealth, and the firmware won't boot it. This is purely for piracy purposes and has nothing to do with cheaters :eek: You can't cheat with a modified firmware, you can't "ruin peoples online experience" or "gain an unfair advantage". You can play 1:1 backups of retail games without modification to the game files. And that's it o_o

Even if they do get some clients/idiots, the only people who are gonna see any money would be the lawyers. The clients at best might get $100 out of the deal. Meanwhile, Microsoft can take the names of the idiots who signed up in the lawsuit and flag the system to reject any future attempt to sign up for Live in their name.

You don't need floppies to make a backup. Do you not know anything about computers and making "back ups"? A backup is a copy of the original file on another disk, CD, DVD, memory stick or external harddrive, it does not have to be on a floppy diskette.

I remember several times, people floating around in halo, or COD5. Kind of like no clip.

I remember once being shot by a sniper in cod five, who was under the inside a building, half way across the map.

I'm pretty sure that he meant that the data stored on the optical disc wasn't as vulnerable to environmental damage like magnetic storage is. While a magnetic disk could be damaged by all sorts of magnetic sources around it amongst other things, an optical disc will last pretty much untill the reflector doesn't begin to oxidize so long as you don't abuse it. Really, in most cases, a well taken care of disc will long out live the drive it's being played in.

This is the reason why I tell people not talk shit on Xboxlive about how they Mod there Boxes other wise they get band or possible arrested. I was playing Multi-player Gears of War online with some jerk who was bragging how smart nerdy he was, who burn his games. Next day later I heard news report some guy in California got arrested for Modding his Xbox 360 I don't know if this was the same guy who was talking smack on Xbox Live I was assuming it was him






A friend of mine I known on Xbox Live had to buy a new Xbox and a new account because of this

As someone who actually studies the law for his chosen profession, and isn't just an armchair online copyright/contract lawyer, I know that this lawsuit, probative or not, is destined to fail.

To address several of the claims made in this thread:

Yes, they did violate a contract. Microsoft is well within its rights to ban these people for violating the ToS/EULA. Yes, you CAN give up rights by entering into a contract. That's what most contracts involve, after all. It's the agreement to give up certain rights in order to use a service. This incident is no different from signing a prenuptial agreement or signing a school permission slip.

Yes, people under 18 can enter into contracts, DEPENDING ON WHAT THE CONTRACT IS. There are certain contracts, such as marriage licenses or credit agreements, that people under 18 (or the age of majority in their jurisdiction), cannot sign unless they have the permission or the cosign of a legal guardian. However, documents such as software agreements and ToS/EULA do not fall under this category in any jurisdiction that I am aware of. And if they did, there would almost certainly be laws that would prevent minors from purchasing ANYTHING that had a ToS/EULA. Even then, this lawsuit would be a non-issue because the responsibility would fall to the purchaser (who would be a legal guardian) and the consoles would STILL be banned regardless.

I did indeed. Which was my 'lolbackups' remark.

Also the 360 pretty much rips the whole disk when you save it to the hard drive anyway in order to cut down on both disc and drive wear. So I don't see why people always bring up the "I need teh backups" thing. If your that worried about 'backups' then why not make the most out the replacement programs/ESA's that almost every big box retailer offers for video games if they are damaged? Backing up user created data on a PC and backing up a game isn't really the same thing.

I just didn't buy an Xbox because I knew some shit like this was going to happen, and didn't want to be part of what I see happening here, which basically all it is, is a bunch of guys stuck between defending their purchase and defending any semblance of common sense. And say what you want about "It was the CONTRACT, THE CONTRACT!", but if more contracts were written with common sense in mind (and in common English), I think you'd see a lot fewer of them between providers and consumers. Half the reason I went with PS3 was just because I figured, if I'm going to get fucked over on the online side, at least I'm not buying 1) the privilege of using it in the first place and 2) some mickey mouse points that I'm sure are not at all a rip-off in value, dollar-for-dollar.
