Is it really theft if they're crediting you and linking back though?
I think you need the permission from the artist.
I know that you can't do this with videos on Youtube without the permission of the creator, even when you credit him.

Well while in doubt I figured I'd ask anyways so you'd also be known that I'm using it to promote stuff I'm selling. It's just a thing of mine, I can be so paranoid when it comes to copyright that I register all the songs I create, for instance xP

I know that you can't do this with videos on Youtube without the permission of the creator, even when you credit him.
Copyright is tricksy I suppose.

You can theoretically do it without if you only use so little or for educational purposes, but YouTube is pretty act first ask later.

But technically I couldn't press charges if they linked and credited in the states. I mean I could, but I'd lose.

But then again it is always better to ask the artist first in case they do have an issue. Saves trouble. But it's Gui and they're helping promote. OwO

For example, there's a little clause in there that if you fully redraw something (not tracing) and can prove it, you can retain ownership of the piece even if it wasn't originally your own. That's why some art theft claims get really hairy.

It's a good idea to register them though. You can't copyright an idea, but if you have it registered you have an official timestamp saying you created it then.

Part of why I usually just shove old art into scraps, and leave old accounts active even if I'm never touching them again. So there's timestamps.

Yes, copyright is very difficult.
In my first college since it was a business school we had an ENTIRE CLASS on copyright. O-o

And we did some things that technically would have violated copyright.






Had we not been doing them for education.
So I have a mock NatGeo spread in my Graphic Design portfolio that could get me into a lot of trouble, except it won't and can't because I did it for and during a class assignment and can easily go back to the professor/school and get them to verify.

It is amazing and one of my best pieces. I also have some great post-apocalyptic photomanipulations in there. I really need to redo my entire portfolio but.

According to copyright, you are correct.
By the Berne's Convention and the laws of Brazil copyright is automatically attributed to the artist once their song is created, so registering is optional - but it provides more strength legally speaking as Sky's mentioned.
Same with the US's copyright laws.

There was a HUGE debacle about it with the Avatar movie. They patented the name, making it so the Last Airbender had to stop using it despite them technically having it first. So going the extra mile to ensure your saftey may help, and it's really harder to keep music safe than it is visual art. I'm REALLY BAD at remembering to sign my work for example.

Taylor Swift also patented some phrases for a bit until they were revoked after some serious petitioning and legal cases.
